BRAZIL: GOVERNMENT AGENCIES
Welcome. This is a resource page with all important government websites that individuals, government leaders and business owners need to know about nowadays. After publishing The Global Financial Crisis Manifesto — A Warning by A Genius Consultant in April 21, 2019 I noticed a huge, enourmous amount of fraud happening online using the name of government agencies and government organizations. Fake websites posing as government websites for Phishing purposes, Fake military websites using the EXACT SAME DOMAIN NAME but ending with .com (commercial) instead, among other very serious cases. True, honest people — especially us christians — will go to proper channels first to solve our problems since we believe in doing the right thing and having an organized society. But once those channels are being spoofed and faked — and GOOGLE is ranking these fake websites 1st on its Search Results instead of the official channels (?!?!) — then it’s clear that something shady is going on which prompted me to take additional action and publish this resource. Another problem I have been seeing is the rise of corrupt government agents thinking they can act freely as criminals now, and also fake government agents. Yes, another harsh reality. We have more monkeys to deal with. But once again, I believe in good people working for the government and I also believe that governments themselves can clean up their own mess, since we entrepreneurs already have to deal with criminal Big Tech and go to war against them nowadays. Finally, I think that part of these fake websites may have been created by Intelligence Agencies themselves, as some sort of “Honey Pot online structure” built to investigate and capture criminal individuals worldwide. After all, let’s remember that we do live in a world where the government itself goes up against its own people, creating countless anti-business laws, teaming up with corrupt corporations and corrupt businesspeople and establishing monopolies/duopolies, mismanaging and stealing government money that should go to HealthCare, Public Safety, Education and more. Ultimately, this resource page will become handy when World War III begins, since we will all need critical information about a sector of a country (like Energy, Water Supply etc) or when we will need to find a country’s online channel or resource to file some complaint/lawsuit or whatever. Therefore, let’s use the proper government channels as much as possible — unless the day comes that it all doesn’t work anymore. But until that day comes, here they are. Enjoy the resources.

For instance, if you have a problem with a TELECOM company, which government agency do you go to, to file a complaint, a report or a lawsuit in that particular country? If something happens to the telecom company you use then your business is basically offline, as we are all operating under the infrastructure of a few telecom companies (worldwide). The main communication channels of Brazil’s Federal Government. The Federal Government of Brazil is the national government of the Federative Republic of Brazil, a republic in South America divided in 26 states and a FEDERAL district, totalizing 27 states in practice. The Brazilian federal government is divided in three branches: 1) The Executive, which is headed by the President and the cabinet; 2) The Legislative, whose powers are vested by the Constitution in the National Congress; 3) The Judiciary, whose powers are vested in the Supreme Federal Court and lower federal courts.

Responsible for regulating the Telecommunications sector and for holding Telecom companies accountable for consumers in Brazil. Whenever you have a problem with a Telecom company — i.e. those who provide cellphone/internet service — that DOES NOT get resolved by the Telecom company itself, ANATEL is the place to go. There’s now THE ANATEL CONSUMIDOR interface if you want to file a complaint online.

OBJECTIVE:
Responsible for administrating tax collection and the customs of Brazil. It also controls noncompliance, smuggling, piracy and drug trafficking, partnering with the Federal Police (Policia Federal) in some cases. Responsible for federal law enforcement in Brazil, in areas such as Tactical Ops, Bomb Disposal Unit, Cybercrime Repression, Immigration and border control, Airport security, Witness Protection Program among other duties.

SUPREMO TRIBUNAL FEDERAL (STF)

OBJECTIVE:
The Constitutional Court of Brazil. It is the highest court of law in Brazil for constitutional issues and its rulings cannot be appealed. The Court has a small range of cases of original jurisdiction, including the power of judicial review, judging the constitutionality of laws passed by the National Congress, through a Direct Action of Unconstitutionality (Acao Direta de Inconstitucionalidade or ADI). There are also other mechanisms for reaching the Court directly, such as the Declaratory Action of Constitutionality (Acao Declaratoria de Constitucionalidade or ADC) and the Direct Action of Unconstitutionality by Omission (Acao Direta de Inconstitucionalidade por Omissao or ADO). All judicial and administrative meetings of the Supreme Court have been broadcast live on TV since 2002. The Court is open for the public to watch the meetings. Questions involving exclusively non-constitutional issues, regarding federal laws, the highest court is, by rule, the Superior Court of Justice.

SUPERIOR TRIBUNAL DE JUSTIÇA (STJ)

OBJECTIVE:
The highest appellate Court in Brazil for non-constitutional questions of federal law. The STJ also has original jurisdiction over some cases. A Special Appeal (Recurso Especial) can be made to this court when a judgement of a court of second instance offends a federal statutory provision or when second instance courts have issued different interpretations of the same federal statute. By rule, the STJ decides only questions of law, not any questions of fact and the probatory elements on the case, about which the Second Instance Courts give the last word. The Superior Court of Justice had its competence slightly altered by an Amendment in 2004, which transferred to the Court cases like the homologation of foreign court orders.

ORDEM DOS ADVOGADOS DO BRASIL (OAB)

OBJECTIVE:
The Organization of lawyers who are responsible for the regulation of the legal profession in Brazil. Graduates in Law from any university who wish to act on behalf of clients and represent them before a Court of Law MUST register at the Order of Attorneys of Brazil (OAB). Only those who are duly registered can provide legal consultation and appear before a Court of Law. It’s an organization independent from the brazilian government, but it has some public powers, which include disciplinary action over its members.

ADVOGACIA GERAL DA UNIAO (AGU)

OBJECTIVE:
Responsible for advising the Executive Branch and for representing the federal government of Brazil in legal proceedings. The Attorneys who compose the AGU are divided in four careers: the Attorney for the National Treasury (Procuradores da Fazenda Nacional), who represent the federal government in tax and financial issues; the Attorney for Brazil (Advogados da Uniao), who represent the government through general cases, the Attorney for the Federal Agencies (Procuradores Federais), who represent the federal agencies; and Attorney for the Central Bank (Procuradores do Banco Central). Their functions are not limited to the Judiciary, and they are also responsible for inside legal control of the government and international legal representation of the Republic.

TRIBUNAL DE JUSTIÇA (TJ – SP)

OBJECTIVE:
The highest court of a state judicial system is its court of second instance, the Courts of Justice. Each Brazilian State has only one Court of Justice. The courts of appeal, meaning they can review any decision taken by Trial Courts, and have the final word on decisions of law at the STATE level. Example of States in Brazil: Sao Paulo, Santa Catarina, Minas Gerais, Rio de Janeiro etc.

BANCO CENTRAL DO BRASIL (BACEN)

OBJECTIVE:
The Central Bank is linked with the Ministry of the Economy. Like other central banks, the Brazilian central bank is the principal monetary authority of the country. One of the main instruments of Brazil’s monetary policy is the Banco Central do Brasil overnight rate, called the SELIC rate. The bank is active in promoting financial inclusion policy and is a leading member of the Alliance for Financial Inclusion.

COMISSAO DE VALORES MOBILIARIOS (CVM)

OBJECTIVE:
The Securities and Exchange Commission is the securities market authority in Brazil. It regulates the capital markets in the country and all of its participants. This includes stock exchanges, public companies, financial intermediaries and investors. It is an independent agency linked to the Ministry of Finance. The CVM has the following objectives: 1) to assure the proper functioning of the exchange and over-the-counter markets; 2) to protect securities holders against fraudulent issues and illegal actions; 3) to protect consumers against fraud and market manipulation; 4) to make sure that markets are transparent and companies disclose all relevant information; 5) to make sure that all market participants adopt fair trading practices; 6) to promote investment in financial markets and increase the capitalization of Brazilian publicly held companies. The CVM has the following Responsibilities: 1) Supervises all market participants and has the power to set rules and discipline participants as well as license financial intermediaries; 2) It runs a register of all publicly held companies and makes sure that those companies adhere to listing rules; 3) The CVM defines the rules for securities trading on the stock exchanges and can suspend or cancel trading, issuance or distribution of securities and if necessary suspend stock exchange operations.

POLICIA MILITAR (SAO PAULO – SP)

OBJECTIVE:
Responsible for policing and for maintaining public order. The police force that is responsible for protecting the people in Brazil on the streets. Each state in Brazil has one dedicated police unit for that particular state, however sometimes the unit may not be big enough. The states of Roraima, Amapa, Acre, Rondonia, Rio Grande do Norte and Rio de Janeiro, plus the Federal District have a higher proportion of Military Police. In the Federal District, for each military police there are 137 inhabitants. At the opposite extreme, the states with the lowest ratio of military police are Para, Maranhao, Piaui, Ceara, Mato Grosso do Sul, Parana and Rio Grande do Sul. Maranhao has the lowest, with 822 people per military police.

Responsible for doing detective work and for handling forensics in a crime scene. The police force that investigates crimes against the patrimony or against someone’s life, like minor fraud cases. Each state in Brazil has one dedicated police department for that particular state. The Civil Police also has special divisions, such as The Special Investigations Department, which is the information organ of the states police responsible for the highly complex police investigations; yet as its duty it has the dignitaries safety and the maintenance of the Special Operations Services (GOE and others) which uses highly trained policemen in dangerous tasks that the Police have to face daily.

AGENCIA NACIONAL DE AVIACAO CIVIL (ANAC)

Responsible for regulating and overseeing civil aviation activities, and aeronautics infrastructure. All aviation-related operations must pass through ANAC approval process first. ANAC regulates the concessions of Brazilian airlines, such as TAM Airlines, Avianca Brazil, Gol Airlines and Varig (VRG Airlines) among other brands. ANAC also regulates the number of maximum operations (slots) in some airports due to capacity limitations.

A governmental military organization of the Aeronautics Command, and subordinated to the Ministry of Defense. ÓRGÃO DE PROTEÇÃO AO CONSUMIDOR (PROCON – SP)

OBJECTIVE:
The government agency responsible for holding businesses in Brazil accountable. Whenever a consumer does not get what he/she was promised by a company, opening a complaint on PROCON is the answer. PROCON then will contact the company and ask for explanations for why the consumer’s needs weren’t met and may end up giving fines to that company if no solution is provided. OBS: Businesses in Brazil usually hate PROCON.

The state-owned company responsible for operating the national postal service. The company created and manages the Brazilian postal code system known as “Código de Endereçamento Postal- CEP” (Postal Addressing Code). It also provides Express Mail Service (SEDEX) and International Service.

CONSELHO FEDERAL DE MEDICINA (CFM)

OBJECTIVE:
The public agency of the Ministry of Work and Employment officially in charge of professional regulation and medical licensing in the area of medicine in Brazil. The CFM is represented by a regional council in each Brazilian state, which have essentially the same mission as the federal council at state level, including issuing the annual license to practice medicine to physicians. Furthermore, the regional councils function as courts, hearing complaints against physicians and giving punishments when there is evidence of ethical violations. The penalties, as provided by law, may consist of confidential warnings, private censure, public censure, suspension of professional practice. The decisions of regional councils can be appealed to the Federal Council.

Responsible for fiscalizing water-related services whenever there is use of natural water supply. ANA is also responsible for fiscalizing polution levels of national water supply in Brazil. Furthermore, ANA also provides water-related data in real-time and information about Brazil’s water supply. It also provides satellite-generated data.

Responsible for electric energy generation and distribution in Brazil and the third biggest Brazilian electric utility company, after Eletrobras and Energisa. The Federal Senate is the upper house of the National Congress of Brazil. In its current form the Senate has 81 seats, three each for the Federal District and the 26 states. CAMARA FEDERAL

OBJECTIVE:
The Chamber of Deputies is a federal legislative body and the lower house of the National Congress of Brazil. The chamber has 513 deputies, who are elected by proportional representation to serve 4-year terms. The number of seats per state is distributed according to the number of inhabitants per state, according to the official measurement taken by the Brazilian Institute of Geography and Statistics (IBGE) through a census held each 10 years. The Brazilian population is represented by 1 deputy for each 360,000 (~) inhabitants on average, but this proportionality is limited by having a minimum of 8 members and a maximum of 70 members per state.
